(A) Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) In the event any of the described facilities in §§ 51.42 are installed or operated without first having obtained a permit from the city and/or within a designated number of feet from the municipal water supply, then such facilities shall be deemed a nuisance and the governing board shall abate such facility as a public nuisance pursuant to § 93.18 of this code. In addition thereto, any person violating any of the terms of §§ 51.40 through 51.42 is hereby determined to be guilty of a misdemeanor and upon conviction thereof, shall be fined not more than $100 for each offense. A new violation shall be deemed to have been committed every 24 hours of such failure to comply.
