§ 113.13 OTHER PENALTIES
   (A)    Individuals Who Sell: An individual who sells, gives, or otherwise furnishes tobacco, tobacco-related devices, electronic delivery devices, or nicotine or lobelia delivery products to a person under the age of 21 years may be charged a minimum penalty pursuant to the fees as established in Chapter 34 of this Code. The individual shall be entitled to a hearing as provided in section 113.12(B).
   (B)    Persons Under 21: Persons under 21 found in unlawful possession of, or who unlawfully purchase or attempt to purchase tobacco, tobacco products, tobacco related devices, electronic delivery devices or nicotine or lobelia delivery products shall be found in violation of this chapter and subject to appropriate penalties established by Council ordinance resolution from time to time, which may include ordinance violations, juvenile petty citations, and/or tobacco related education classes, diversion programs, or community service.
   (C)    Misdemeanor: Nothing in this section shall prohibit the City from seeking prosecution as a misdemeanor for any violation of this chapter.
