§ 115.40 PATIO PERMIT.
   (A)   Patio permit. A liquor licensee may cause or permit the sale and/or consumption of alcoholic liquor upon the licensed premises, but outside the licensed permanent structure, if it has obtained a permit and not otherwise. This shall be identified as the patio area. A violation of this section shall subject the offender to a penalty as provided in the Code of Ordinances of the Village of Ramsey and shall be cause for the revocation of the license so issued.
   (B)   Patio permit issuance procedure. A patio permit shall issue to a Class C, D or E licensee if the following criteria is met at the time a written application for the permit is made.
      (1)   There shall exist solid fencing not less than six feet in height, the bottom of which shall be not more than six inches above ground level, made of wood or other similar materials, encompassing the patio area where alcoholic liquor is to be sold and/or consumed.
      (2)   The fencing shall be designed and positioned so as to separate the licensee's patrons situated within the patio area from the general public and to provide screening from viewing by the general public for those individuals occupying that area.
      (3)   Access into the patio area shall be from the permanent structure only and no access shall be permitted from the street, sidewalk, or adjoining property. There shall be an emergency patio area exit opening from the inside, outward only.
   (C)   Use of a permit.
      (1)   No music of any kind may be played or broadcast from the patio area except small speakers at low volume before 9:00 p.m. on Sunday, before 10:00 p.m. Monday through Thursday, and before midnight Friday and Saturday.
      (2)   No sales or dispensing of alcoholic liquor may be made from the outside area or permanent structure to any person upon adjoining property, public street, sidewalk, or alley, and no alcoholic liquor shall be removed from the outside fenced area or the permanent structure.
      (3)   All outside activities of any type may not begin prior to 12:00 p.m. noon.
   (D)   A failure to adhere to all permanent use requirements as set forth hereinabove shall constitute a basis for permit revocation.
