§ 131.23 PURCHASING, ACCEPTING OR POSSESSING UNLAWFUL.
   (A)   It is unlawful for a person who is under 21 years of age to purchase, accept receipt of or have in his or her possession a tobacco product, or to present or offer to any person any purported proof of age which is false, fraudulent or not actually his or her own for the purpose of purchasing or receiving any tobacco product.
   (B)   However, it shall not be unlawful for such a person to handle tobacco products when required to in the performance of such person’s duties.
