§ 35.16 PURCHASING PROCEDURES.
   (A)   Contractual services defined. For the purpose of this subchapter, the following definition applies unless the context clearly requires a different meaning.
      CONTRACTUAL SERVICES.
         (a)   Services performed for the town by persons not in the employ of the town, which may include the use of equipment or the furnishing of commodities in connection with the services under express or implied contract.
         (b)   CONTRACTUAL SERVICES shall include travel, freight, express, parcel post, postage, telephone, telegraph, utilities, rents, printing out, binding, repairs, the alteration and maintenance of buildings, equipment, streets, bridges and other physical facilities of the town and other services performed for the town by persons not in the employ of the town.
   (B)   Purchase authorizations. All purchases of supplies, materials, equipment and contractual services for the offices, departments and agencies of the town government shall be made by the Town Board of Trustees or by other town personnel in accordance with the purchase authorizations issued by the Town Board of Trustees.
   (C)   Prior approval by Town Board. Every contract for or purchase of supplies, materials, equipment or contractual services for more than $5,000 shall require the prior approval of the Town Board of Trustees.
