§ 111.03 PERMITS.
   (A)   It shall be unlawful for any person to operate a public or semi-public swimming pool, public or semi-public wading pool or public or semi-public spa or interactive play attraction in Putnam County, who does not possess a valid permit from the Health Officer; except when the entire operation is receiving inspections by an appropriate state or Federal governmental agency. Valid Putnam County pool/spa permits shall be posted in a conspicuous place at all times.
   (B)   Only persons who comply with the applicable requirements of Rule 410 IAC 6-2.1, Rule 675 IAC 20, and this chapter shall be entitled to receive and retain such a permit.
   (C)   The permit for a full time pool shall be due by January 1 of each calendar year. The permit for a seasonal pool shall be due by May 15 of each calendar year or prior to pool opening if the pool should open prior to that date. All permits expire on December 31 of each year and must be renewed thereafter on an annual basis on the dates described above.
   (D)   Any permit issued by the Health Officer shall contain the name and address of the facility, and any other pertinent data as required by the Health Officer.
   (E)   Required permits shall be provided by the Putnam County Health Officer if a completed application and appropriate fee are presented and the swimming pool, wading pool, interactive play attraction, or spa complies with all applicable requirements of Rule 410 IAC 6-2.1, Rule 675 IAC 20, and this chapter.
   (F)   Any permit issued under this ordinance is not transferable from one person to another person, from one facility to another, or from one type of operation to another.
   (G)   No permit fee shall be required for swimming pools, wading pools, interactive play attraction, or spas operated by a not-for-profit organizations. Such establishments shall comply with all other provision of this chapter.
   (H)   All public and/or semi-public swimming pools, public or semi-public wading pool, interactive play attraction, or public or semi-public spa in Putnam County constructed or renovated after the effective date of this chapter shall comply with Rule 675 IAC 20 Swimming Pool Construction Code, Rule 410 IAC 6-2.1 public and semi-public swimming pools rule, and this chapter. Newly constructed or newly renovated public and/or semi-public swimming pools, public or semi-public wading pool, interactive play attraction, or public or semi-public spa in Putnam County must obtain a permit from the Putnam County Health Department prior to opening.
