§ 111.02 DEFINITIONS.
   The following definitions shall be defined in this chapter as written unless context indicates or requires a different meaning. The definitions set forth in 410 IAC 6-2.1 shall be incorporated herein and shall apply to the application of this chapter as well.
   DEPARTMENT. Putnam County Health Department.
   FACILITY. Any entity that includes a public pool, semi-public pool, wading pool, spa, or any combination thereof, at one address or location, operating either semi-annually or annually, under one pool permit.
   FULL TIME POOL. Any public or semi-public pool, wading pool, or spa that operates for more than six months per calendar year.
   HABITUAL NON-COMPLIANCE. Any repeat violation shown on three consecutive Putnam County inspection report forms.
   HEALTH OFFICER. The Putnam County Health Officer or his/her designee or authorized representative.
   INTERACTIVE PLAY ATTRACTION. A water attraction, including devices using sprayed, jetted, or other water sources contacting the users and not incorporating a basin and standing or captured water as part of the user activity area, such as splash pads and spray pads.
   NOT-FOR-PROFIT ORGANIZATION. An organization exempt from the Indiana Gross Income Tax under I.C. 6-2.1-3-20 through I.C. 6-2.1-3-22.
   PUBLIC POOL. Any pool, other than those pools defined as semi-public pool which is intended to be used for swimming or bathing and is operated by a concessionaire, owner, lessee, operator, or licensee, regardless of whether a fee is charged for use. Nothing in this article shall be construed as applying to any pool, constructed at a one or two family dwelling, and maintained by an individual for the sole use of the household and house guests.
   SEASONAL POOL. Any public or semi-public pool that is operated outdoors for less than six months each year.
   SEMI-PUBLIC POOL. 
      (1)   Any pool restricted for use by residents, members, or registered guests that is intended to be used for swimming or bathing and is operated solely for and in conjunction with:
         (a)   Hotels, motels, apartments, condominiums, bed and breakfasts, or similar lodgings;
         (b)   Camps or mobile home parks; or
         (c)   Membership clubs or associations.
      (2)   Nothing in this article shall be construed as applying to any pool, constructed at a one or two family dwelling, and maintained by an individual for the sole use of the household and house guests.
   SPA. A pool designed for recreational and/or therapeutic use, which is not drained, cleaned, and refilled after each use. The term may include, but is not limited to:
      (1)   Hydrojet circulation;
      (2)   Hot water;
      (3)   Cold water;
      (4)   Mineral baths;
      (5)   Air induction systems; or
      (6)   Any combination thereof.
   SWIMMING POOL. Any structure, basin, chamber or tank containing water for swimming, diving or recreational bathing. This term includes diving pools, therapeutic pools and wave pools.
   WADING POOL. A pool used for bathing that has a maximum depth of two feet.
