1288.07  INTRAVENOUS HYDRATION SERVICES.
   (a)   Purpose. To establish limitations on intravenous hydration services within the Village and to establish reasonable and uniform regulations to minimize and control the negative secondary effects of intravenous hydration services within the Village, all in order to promote the health, safety, and welfare of the citizens of the Village.
   (b)   Applicability. The development regulations established within this Planning & Zoning Code are applicable to the following development criteria:
      (1)   A facility, building, or group of buildings for the purpose of providing intravenous hydration services.
   (c)   Location. No building or facility shall be erected, constructed, or developed and no building or premises shall be reconstructed, remodeled, arranged for use or used for any intravenous hydration services business unless authorized by the issuance of a special use permit in accordance with the requirements herein. In addition, an intravenous hydration services business shall comply with the following special use criteria:
      (1)   An intravenous hydration services business shall be located in a district zoned C-2, General Commercial as provided in Chapter 1274.
      (2)   An intravenous hydration services business must be conducted at a fixed location on rented, leased or privately-owned real property. Business must be conducted so as not to impede the flow of vehicular traffic on public streets and/or so as not to impede the flow of pedestrian traffic on public sidewalks.
      (3)   An intravenous hydration service business shall not be located on or adjacent to any premises licensed to sell or furnish beer, liquor, alcohol and/or other similar intoxicating beverage, whether for consumption on said premises or elsewhere, including without limitation restaurants, bars, liquor and other stores that sell alcohol.
      (4)   An intravenous hydration services business shall not be located within 500 feet from any parcel on which sits a school, church, public library, public playground or public park.
   (d)   Other Requirements. An intravenous hydration services business shall comply with the following requirements in order to be issued a special use permit:
      (1)   An intravenous hydration services business shall be closed and shall not operate between the hours 9:01 p.m. and 6:59 a.m.
      (2)   All parts of the intravenous hydration services business shall at all times be maintained in a neat, clean, sanitary, and safe condition.
      (3)   The owner, operator, or person in charge of an intravenous hydration services business shall allow state or local authorities, including law enforcement officers, access to any and all parts of the premises for the purpose of making health or safety inspections.
      (4)   Intravenous fluids may be administered only by persons who have been specifically trained and are authorized to perform that duty in accordance with the laws of the State of Ohio.
