802.03 LICENSE APPLICATION; LICENSE REQUIREMENTS.
   (a)   All applications for business licenses shall be made to the Fiscal Officer, or his or her designee, in writing upon forms furnished by the Village and shall contain, at a minimum, the following information:
      (1)   The name and address of the principal place of business;
      (2)   The name and address of the applicant and all individuals having an ownership interest in the business, their business occupation, place of business and business address and residence. If the owner is a corporation, limited liability company, or other nonpersonal business entity, the name and address of the resident agent(s) or other person representing the entity shall be provided;
      (3)   The address of all locations within the Village at which the business intends to operate;
      (4)   Business telephone number and business fax number;
      (5)   A detailed description of the nature of the business and the services or goods to be provided;
      (6)   The Ohio vendor license number/sales tax number for the business;
      (7)   A Federal identification number for the business;
      (8)   Resort Area Gross Receipts Excise Tax account number for the business;
      (9)   Proof of State license, if one is necessary for business conducted; and
      (10)   Such other information concerning the applicant and his or her trade, business or profession as may be reasonable and proper, having regard to the nature of the license desired.
   (b)   A separate license is required for each business unit operating in the Village. A building or property containing one or more business units with each unit representing itself to the public as a separate business or merchandising storefront shall be treated as a separate location for reporting and licensing purposes. The following acts shall create a rebuttable presumption that a person is engaged in a business unit operation: (i) displaying a sign or advertisement indicating the conduct of a business or profession at a given location; (ii) advertising a business or profession in a classified section of the telephone directory, in the Put- in-Bay Chamber of Commerce business publication, in newspaper advertisements, on the internet, or any other media; or (iii) except for a business classified as a food court, where customers are not free to leave the business unit without being required to pay for merchandise or services, shall be evidence that such person is holding himself out to the public as operating a business unit or profession.
   (c)   Each business license must be renewed annually. If there are no changes to the above-required information and the licensee is in good standing, renewal of an annual license may be granted upon the initial application filed with the Village provided that the renewal fee is paid in full.
   (d)   Each business must be conducted at a fixed location on rented, leased or privately- owned real property. If leased or rented, a copy of the signed lease or rental agreement must be provided with the license application. Business must be conducted so as not to impede the flow of vehicular traffic on public streets and/or so as not to impede the flow of pedestrian traffic on public sidewalks.
   (e)   At the time of making the application for the required business license the applicant shall pay to the Village the license fee as established for each business unit in the Village where the applicant proposes to carry on business, as defined in subsection (b) hereof.
   (f)   In the event that there is any change or transfer of the ownership of a business or enterprise, a new application shall be required within sixty days of the change or transfer of ownership. The new owner shall deposit the fee required for an original license with the application reflecting said change or transfer of ownership.
   (g)   It shall be unlawful to knowingly make a false statement or representation in a license application.
