642.31 OVERNIGHT CAMPING PROHIBITED.
   (a)   As used in the section:
      (1)   “Recreational vehicle” means a transportation structure, self-propelled or capable of being towed by a passenger car, station wagon or small pick-up truck, of such size and weight as not to require any special highway movement permits, and primarily designed or constructed to provide temporary, movable living quarters for recreational, camping or travel use, or to carry such equipment, but not for profit or commercial use. Included as recreational vehicles, but not to the exclusion of any other types not mentioned in this section are: trailers, trailer coaches, camping trailers (including tent-type fold-out camping trailers), travel trailers, motor homes, pick-up (slide-in) campers; converted vans; mini-motor homes; fifth wheel trailers of recreational vehicle construction, design and intent, and truck cabs.
   (b)   Generally.
      (1)   It shall be unlawful for any person to engage in or allow overnight camping in the Village, except as hereinafter specifically permitted.
         A.   Residential property. On residential zoned property within the Village, it shall be permissible for bona fide guests of the property owner, or guests of the current tenant of the property, to engage in overnight camping by placing not more than two tents, or parking one recreational vehicle, in the rear yard of any lot improved with a dwelling. Overnight camping on a residential zoned parcel is restricted to not more than seven days in a calendar year. The owner or tenant of a residential property within the Village shall not be permitted to rent or lease camping space. Restroom facilities for overnight camping must be provided by the property owner on the property where the overnight camping takes place.
         B.   Commercial property. On commercial zoned property it shall be permissible for the owner of the licensed business occupying the commercial zoned property, or his authorized representative, upon applying for and being issued an overnight camping permit and paying a permit fee of fifty dollars ($50.00), to allow one recreational vehicle to be parked on the business premises for up to a total of four consecutive days, provided the recreational vehicle is owned or leased and occupied only by individuals who have a previously scheduled written agreement to present a public performance on the licensed business premises during the time period of the requested overnight camping permit. Not more than one overnight camping permit shall be issued for a commercial zoned property at one time. Not more than one recreational vehicle used for overnight camping shall be parked on a commercial zoned property at any time. The recreational vehicle used for the permitted overnight camping shall not be parked in any of the required parking spaces required by the Village's current zoning code for the business occupying the commercial premises. The recreational vehicle engaged in permitted overnight camping shall not be connected to any external LP or propane gas source, and shall not be connected to any sanitary sewer line connected to the Village's sanitary sewer collection system.
      (2)   The Mayor is hereby authorized to develop an overnight camping permit application and permit, and is further authorized to promulgate rules and regulations for the issuance of overnight camping permits on commercial zoned property. Such rules and regulations shall be consistent with the intent of the provisions of this section and supplementary to the provisions of the Codified Ordinances of the Village. The rules and regulations developed shall first be approved by motion of Council. Upon the issuance of the overnight camping permit, the permit shall be prominently displayed on the front window of the recreational vehicle.
   (c)   Penalty. Whoever violates any of the provisions of this section is guilty of a minor misdemeanor for the first offense and a misdemeanor of the fourth degree for a second offense within a one-year period.
