248.04 DRUG-FREE WORKPLACE POLICY.
   In accordance with Public Law 100-690, the Village of Put-in-Bay is hereby declared to be a drug-free workplace. The following shall be implemented as a part of this policy:
   (a)   The Village shall publish a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited when such employees are employed by the Village of Put-in-Bay.
   (b)   Legal action may be taken against employees who violate local, State or Federal drug laws.
   (c)   A drug-awareness program shall be developed to inform employees about the dangers of drug abuse in the workplace; the Village's policy of maintaining a drug-free workplace; the available drug counseling, rehabilitation and employee-assistance programs; and the penalties which may be imposed for drug abuse violations.
   (d)   Each employee shall receive a copy of this policy.
   (e)   Each employee shall be made aware that this policy is a condition of employment with the Village of Put-in-Bay. Therefore, the employee shall abide by the terms of this policy and notify the Village of Put-in-Bay of any criminal drug statute conviction for a violation occurring in the workplace, no later than five days after such conviction.
   (f)   Any state, Federal or local agency shall be notified, if legally required by the Village, within ten days after receiving such notice from an employee or otherwise receiving actual notice of such conviction.
   (g)   The Village of Put-in-Bay shall take the following action within thirty days after an employee is convicted of a drug abuse violation:
      (1)   Personal action against the employee, which may include termination of employment; or
      (2)   Require the employee to participate in a drug-abuse assistance or rehabilitation program approved for such purposes by a Federal, State or local health, law enforcement or other appropriate agency.
   (h)   The Chief of Police of the Village of Put-in-Bay is hereby directed to act as the coordinator of this program.
