874.05   APPEAL PROCEDURE.
   Any person aggrieved by an order of the Mayor with respect to the suspension of the right to operate an uninsured for-hire moped may appeal the suspension to the Council. All appeals shall be perfected in the following manner:
   (a)   The owner must file a written Notice of Appeal with the Fiscal Officer, on a form provided by the Fiscal Officer, within ten days after receipt by him or her of the suspension.
   (b)   The owner must deposit with the Fiscal Officer a fee of thirty dollars ($30.00), which sum shall be refunded to the owner only if the Council renders a decision in favor of the owner. Otherwise the deposit shall be forfeited and placed into the general fund of the Village.
   (c)   Within five days after receipt by the Fiscal Officer of the Notice of Appeal, the Fiscal Officer shall cause a true copy of the Notice of Appeal to be delivered to all members of Council.
   (d)   Within ten days after delivery of the Notice of Appeal to the members of Council, the Council shall convene a meeting for the purpose of hearing the appeal.
