The Mayor shall have the power and authority to.
(a) Adopt rules and regulations, governing the issuance of taxicab and taxicab driver licenses, the inspection of vehicles for hire and their appurtenances, or any other matter under his or her supervision and control, as are reasonable and necessary and not inconsistent with Chapter 866. A copy of all such rules and regulations shall be distributed to licensed drivers and owners at the time of issuance or renewal of licenses.
(b) Subpoena witnesses and evidence, and to act upon, make findings upon, and grant or deny taxicab and taxicab driver's licenses or to suspend or revoke such licenses for violations of Chapter 866 or any rule or regulation lawfully promulgated by the Mayor pursuant to this chapter.
(c) Place on licensing probation a taxicab driver or taxicab owner.
(d) Charge any person, corporation, partnership, or any entity owning or leasing a taxicab, and/or any person having, or required to have, a taxicab drivers' license with a violation of this Chapter 866.
(e) The Council shall, at least once a year, conduct a public hearing to determine the total number of taxicabs which may be licensed within the Village based on consideration of public convenience and necessity. The Council's determination made pursuant to this section shall be based upon the following factors:
(1) Public demand for taxicab service;
(2) Whether the public has been adequately served by existing permitted taxicab service and other forms of mass transportation;
(3) The relationship of the total number of permits to the revenue of the existing permit holders and the effect on the wages or compensation, hours, or conditions of service of drivers of taxicabs;
(4) South Bass Island area population and statistics, including tourist population;
(5) The effect on traffic congestion and the safety of existing vehicular and pedestrian traffic;
(6) Such other factors as the Council finds to be relevant.
The Council shall make its determination as to the total number of taxicabs to be licensed by December 14 of each year.
