§ 151.06  LIABILITY; FLOODING.
   (A)   This subchapter does not create any liability on the part of the county, the state, DNR, or any elected or appointed official, or employee thereof, for any flood damages that result from reliance on this subchapter or any administrative decision lawfully made thereafter.
   (B)   (1)   Special exception used may be permitted in the Floodplain Overlay District; provided, they do not conflict with underlying regulations and only after a permit, or letter of recommendation, has been granted by DNR.
      (2)   All terms and conditions imposed by DNR shall be included in any approval granted by the County Board of Commissioners.
      (3)   The Board may impose greater restrictions. All buildings, or additions to existing buildings, shall have flood protection grades at least two feet above the regulatory flood profile.
   (C)   Residential sewage disposal system permits will not be issued by the County Health Department for any dwelling in the floodplain. This decision is in accordance with I.C. 6-8.1.
