For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates, or requires, a different meaning.
BOARD. The County Board of Commissioners. The County Board of Commissioners may create a Board of Review having jurisdiction to hear, and determine, petitions that are filed after the petitioner has received a written letter of denial from the County Building Inspector. Said Board of Review shall consist of between five and nine persons who are residents of the county and have an interest in real estate located in the county. The Board of Review shall hear petitions for review pursuant to procedures established by the BOARD, and also as set forth in this subchapter, and determinations made by the BOARD shall be by a majority vote of the BOARD members. A quorum of the BOARD shall consist of at least 60% of the appointed BOARD members being present at a public hearing, and after proper notice has been given as provided by the State Open Door Law, being I.C. 5-14.
BUILDING INSPECTOR. The duly appointed representative of the County Board of Commissioners to administer, and enforce, this subchapter.
COUNTY. Any and all residential properties located in part, or in whole, within the boundaries of the county, including, but not limited to, any and all property situated in cities, towns, incorporated, and unincorporated areas, and including any and all areas within, and under, the jurisdiction of the County Board of Commissioners.
DWELLING. Any part of any dwelling, or its premises, used as a place of residence or habitation, or for sleeping by any person.
MANUFACTURED OR MOBILE HOME. A dwelling unit built since January 1, 1985 in an off-site manufacturing facility for installation or assembly at the building site, bearing a seal certifying that it is built in compliance with the Federal Manufactured Housing Construction and Safety Standards Code, or I.C. 22-8-1.1, as promulgated by the State Department of Fire Prevention and Building Safety.
NUISANCE. Whatever may be injurious to health.
ORDER. Any written directive issued by the County Board of Commissioners in accordance with § 151.05(C).
OWNER. Any one, or more, of the following:
(1) The owner, or owners, in fee simple of a parcel of real estate including the life tenant, or tenants, if any;
(2) The record owner, or owners, as reflected by the County Recorder’s Office;
(3) The purchaser, or purchasers, of such real estate under any contract for the conditional sale thereof; and/or
(4) The person, or persons, in control of the property as executor, executrix, trustee, receiver, or guardian of the owner.
PERMIT. The building permit received from the Building Inspector to build or remodel a dwelling, or to move a mobile dwelling into the county.
PERSON. Any individual, partnership, co-partnership, firm, company, corporation, association, trust, estate, or any other legal entity, its or their successors or assigns, or agents of the aforesaid.
PLUMBING. All of the following supplied facilities and equipment: Gas pipes; gas burning equipment; water pipes; garbage disposal units; waste pipes; water closets; sinks; installed dishwashers; lavatories; bathtubs; shower baths; installed clothes washing machines; catch basins; drains; vents; and any other similar supplied fixtures, and the installation thereof, together with all connections to water, gas, or sewer lines.
PREMISES. A platted lot, or part thereof, or unplatted lot or parcel of land, or plot of land, either occupied or unoccupied by any dwelling or non-dwelling structure, and includes any such dwelling, accessory structure, adjoining alley, easement, or drainage way. Lot coverage shall be no more than 35% of the entire premises.
UNFIT FOR HUMAN HABITATION. A condition of a dwelling which is dangerous or detrimental to life or health because of want of repair, defects in drainage, plumbing, lighting, ventilation, or its construction, infection with contagious disease, or the existence on the premises of an unsanitary condition likely to cause sickness among occupants of the dwelling.
