§ 70.01  TRAFFIC ON COUNTY ROADWAYS.
   (A)   A variety of traffic control signs regulating the use of roadways and rights-of-way under the authority of the county have been placed since the joint ordinance of June 14, 1993, and have been placed, designated, and maintained by oral authority for which no specific county ordinance was enacted, and the County Council, as the legislative body, desires to ratify and affirm the placement, legal effect, and enforceability of all such county signs.
   (B)   In the future after the enactment of this section, additional traffic control devices may be needed to be placed and maintained to regulate traffic on county highways, roadways, rights-of-way, and public easements.
   (C)   From and after the passage of this section, all existing traffic control signs previously placed, or maintained, by the County Highway Department throughout the county regulating traffic speed, parking, intersections, vehicle weight, entry and exit, stopping, yielding, direction (one-way, two-way), and the like, are hereby given full force and legal effect. This section includes all previously placed traffic control signs not covered by the June 14, 1993 joint ordinance, and hereby ratifies and affirms their legality.
   (D)   This section is created to approve the placement of any other future traffic control devices which the county hereby orally authorizes the County Highway Department to place. Said authorization shall be noted in the minutes of the County Board of Commissioners and County Council.
   (E)   It shall be a Class C infraction for any person to operate a motor vehicle in the county in violation of the traffic control signs and devices covered by this section. It shall not be a defense that there was no specific ordinance previously adopted at the time the traffic control sign or device was placed. The prosecuting attorney or the County Attorney may prosecute such actions on behalf of the county. Any judgment entered against a person shall be payable to the county, together with costs of the action.
