§ 51.30  DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COMMERCIAL ESTABLISHMENT.  Any office, retail store, restaurant, hotel, motel, garage, trailer park, charitable or governmental office or private clubs.
   GARBAGE.  Includes all putrescible wastes, except sewage and body waste, including waste accumulated of animal food or vegetable matter, and waste that attends the preparation, use, cooking, dealing in storing meat, fish, fowl, fruit and vegetables and all of such wastes or accumulation of vegetable matter of residences, restaurants, hotels and places where food is prepared for human consumption.  The term GARBAGE shall not include recognized industrial by-products.
   REFUSE.  Includes solid waste, including garbage, rubbish and yard trash.
   RUBBISH.  Includes refuse other than garbage (tin cans, bottles, ashes (cold), paper, pasteboard, cardboard or wooden boxes or other waste materials produced in the normal course of doing business or every day living).  The term RUBBISH shall not include recognized industrial by-products.
   SOLID WASTE MATTER.  Useless, unwanted or discarded material or matter with insufficient liquid content to be free flowing.
   SOLID WASTE MANAGEMENT.  The purposeful, systematic control of the storage, collection, transport, processing and disposal of solid waste.
   SUITABLE SOLID WASTE CONTAINERS.
      (1)   COMMERCIAL.  Containers constructed of metal or plastic, with tight fitting cover of a capacity of not less than 2 cubic yards and not more that 8 cubic yards constructed so as to permit its use with the loading and hauling equipment as provided by the town for the removal of garbage and waste matter from the commercial and manufacturing establishments within the town.
      (2)   RESIDENTIAL.  Containers constructed of metal or plastic with tight-fitting covers of a capacity of not more than 32 gallons.  Heavy duty plastic bags may also be used, but should not contain wastes that attract animals or other scavengers.  In this case, heavy duty plastic bags shall be placed in places where metal or plastic containers would normally be placed.
      (3)   YARD TRASH CONTAINERS.  Yard trash may be placed in suitable residential containers listed above, but may also be placed in cardboard cartons, baskets or wooden boxes.
   YARD TRASH.  Includes leaves, weeds, grass or shrubbery cuttings, vines, trees and tree limbs, and other refuse attending the care of lawns or yards.
