§ 111.01  POOL ROOMS.
   (A)   Definition.  For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      POOL ROOM.  Any room, hall, building or place kept for the purpose of operating billiard or pocket billiard tables for the purpose of permitting games to be played thereon for profit.
      POOL TABLE.  Those tables known as billiard tables or pocket billiard tables and shall include such tables as are known as miniature pool tables.

   (B)   Places exempt.
      (1)   The provisions of this section shall not be construed to include billiard tables or billiard rooms operated by private homes, fraternal orders, bona fide clubs, industrial concerns, religious orders or charitable institutions when no fees are charged for the use of the tables.
      (2)   Should fees be charged for use of the tables all of the provisions of this section shall apply.

   (C)   Age limit restrictions.  It shall be unlawful for any person, or persons, firm or corporation owning or operating a pool room within the town to permit any person under 21 years of age to play pool, or otherwise engage in any game played with the use of such table, unless accompanied by his or her parent or guardian.  It shall be unlawful to permit any person under 21 years of age to loiter or loaf in any such pool room, unless accompanies by his or her parent or guardian.

   (D)   Posting notices.  In every pool room there shall be posted on at least 2 walls of the room section where the table or tables are operated, placecards having the preceding section conspicuously written or printed thereon in letters of not less than 1/4 of a inch in height, for the information of the patrons.

   (E)   License tax.  Each person or corporation operating a billiard room in the state shall pay to the Tax Commission, on or before February 1 of each year, a tax of $25.  No city, town or village shall issue a license to any person to run a billiard room until after the Commission shall have first issued a license.  The town shall then license the business in accordance with the provisions set forth in Chapter 110.

   (F)   Gambling prohibited.  It shall be unlawful for any person or persons, firm or corporation to permit any gambling or betting of any nature in the playing of pool or other games on the tables.  It shall also be unlawful to permit any intoxicated person to play or loiter and remain in the pool room. No loud, profane, obscene or indecent language shall be permitted in or on the premises, and the premises shall be kept in a clean and sanitary condition.

   (G)   Time of closing.  The pool room shall be closed at 11:00 p.m. each night and remain closed until 6:00 a.m. the following morning, except that on Sunday no pool table shall be operated for profit or otherwise.  No person shall be allowed to play on any table at any game during the hours that the place is closed.

   (H)   No partition or other obstruction allowed.  In every pool room no screen, curtain, blind partition or other obstruction shall be placed between the entrance of the room where the game is played, and the back or the rear wall of the pool room.  A clear view of the entire interior from the entrance to the rear of the room must be maintained at all times.  No partitions forming rooms, stalls or other enclosures where the public congregate shall be permitted.  This section shall not be construed to prohibit the maintenance of closets for storing purposes exclusively or toilets.

   (I)   Penalty for violation of this chapter.  Any person violating any provision of this section shall, upon conviction in the Town Court, be fined not more than $200, or sentenced to serve upon the public works of the town for not more than 30 days.  The owner of any such pool room, or the manager, clerk or operator thereof shall be subject to the penalties herein imposed.

   (J)   Revocation of license for violation of this section.
      (1)   In the event a pool room shall be operated in violation of this section, or shall be operated in any other manner as to be detrimental to the best interest of the town, the Town Council shall revoke the license for the operation of the pool room after notice to the owner or manage thereof, or the person to whom license shall have been issued, and a hearing  thereon  before the Town Council.
      (2)   In the event such license shall be revoked, it shall be unlawful for any person, or persons, firm or corporation to thereafter operate such pool room and upon conviction before the Town Court, shall be sentenced to pay a fine of $200 or serve 30 days upon the public works of the town.

   (K)   Coin-operated machines.  It shall be unlawful to operate any coin-operated machine, such a coin-operated pool table, flipper machine or pin ball machine, or profit or amusement from the hours of 11:00 p.m. until 6:00 a.m. on Monday through Saturday and at any time on Sundays within the corporate limits of the town.  The provisions of this section shall apply to the owner, manager or person in charge of any business establishment or place where the machines shall be.  Any person convicted of a violation of this section shall upon conviction thereof be imprisoned for a period not to exceed 30 days or fined in an amount not to exceed $200.
