§ 39.15 ADDITIONAL FUNCTIONS OF THE CODE ENFORCEMENT BOARD.
When a waiver, variance, or exception to a city ordinance is requested, the Code Enforcement Board may serve as the forum for the first step in the determination process, using the same procedures, including quorums, enumerated above. The Board, after hearing the requesting party and the Code Enforcement Officer, reviewing any relevant documentary evidence, and the applicable ordinance(s) will develop a written recommendation, including the applicable ordinance(s), why the waiver or exception is requested, and the rationale for the recommendation. The written recommendation will be given to the City Council who will determine whether to grant the waiver, variance, or exception. The requesting party may present their plea to the City Council at the regular meeting where the waiver, variance, or exception is heard.
