The connection of all private drains with the tile drains constructed by the city shall be made under and in accordance with the direction of the superintendent of streets. Every person who shall, without the permission in writing of the superintendent of streets, dig any ditch or trench in or upon any street, alley, park or public ground, or connect any drain with any of the tile drains constructed by the city, or injure or disturb, in any manner, any such tile drain, shall be subject to the penalty as provided in title 1, chapter 4 of this code. Such penalty shall not apply to work done by the employees or agents of the city at the direction of the superintendent of streets.
