§ 94.01 USE OR APPLICATION OF NON-APPROVED MATERIALS ON ROADS.
   (A)   Since the U.S. Environmental Protection Agency and the Department of Health of the State of Indiana have banned and condemned the use or application of non-approved oils, chemicals and emulsion on public roads, and since such use or application has occurred in the town, such use or application is now hereby prohibited.
   (B)   It is hereby declared unlawful for any person or persons, firm or corporation to use or apply any oil, chemical, emulsion, or any other material onto or upon any public road, maintained by the town of, or onto or upon any private street, roadway or drive located within the corporate limits of the town, without the written approval of the Town Council.
