(A) The Town Council shall review the user charges at least annually and revise the rates as necessary to ensure that adequate revenues are generated to pay the costs of operation and maintenance including replacement and that the system continues to provide for the proportional distribution of operation and maintenance including replacement costs among users and user classes.
(B) In order to comply with the requirements contained in Federal Regulation number 40 CFR 35.2140(c) “User Charge System,” the Town Council will notify each user annually of the rate or the portion of the total charge for wastewater treatment that is attributable to operation, maintenance and replacement.
