§ 95.05 OPEN BURNING.
   (A)   No open burning shall be permitted within the town except for open burning that is constantly attended by a person at least 16 years of age until such fire is extinguished. This person shall have a garden hose connected to a water supply, or other fire-extinguishing equipment readily available for use.
   (B)   The Town Marshal may prohibit any open burning when atmospheric conditions, weather conditions, or local circumstances make such fires hazardous, in the Marshal's discretion.
   (C)   If a fire creates a nuisance or hazard, the fire shall be extinguished.
   (D)   Notwithstanding the foregoing, it shall be unlawful for any person to burn, to cause to be burned, or permit to be burned any household garbage or household waste or building materials. This chapter shall not apply to the burning of leaves, twigs, or similar yard waste.
   (E)   It shall be the responsibility of the office of the Town Marshal to enforce this chapter.
