§ 94.16 APPLICATION; FEE.
   (A)   Any firm, person or corporation desiring to obtain a permit for excavating as above provided, shall file with the Building Inspector a written application for such permit, stating the exact location of the proposed excavation, and the purpose of making the proposed excavation, and by filing therewith a cash or a performance bond in the sum of $500 where the excavation is to be made in a paved highway, alley or driveway, and in the sum of $250 for an unpaved highway, alley or driveway. Any excavation to be made across the entire width of a paved highway, alley or driveway shall be bored. Each bore constitutes a separate excavation and bond shall be posted as such. The bond shall be made payable to the town, conditioned upon payment by the applicant to the town of all costs incident to the replacement of the highway, alley or driveway in as good a condition as it was prior to excavation thereof. The bond shall be held for one year; or less as determined by the scope of work performed. It shall be the duty of the Street Department of the town to fill and repair all excavations in the thoroughfares or if the town is unable to repair to the original condition and must obtain outside assistance, the cost of the repair shall be paid by the person, firm or corporation applying for such permit. The cost to be paid within ten days after receipt of notification of the amount of the costs. Upon failure to do so, the bond shall be forfeited to the town. Otherwise, the bond shall be returned to maker thereof, upon receipt of the costs of the repair.
   (B)   The fee for obtaining each permit shall be $25.
