Any owner or other person notified to abate the described nuisance who shall fail to abate such violation within the time specified in the notice, shall be deemed guilty of a misdemeanor. However, the city's prosecuting attorney may elect to refrain from initiating criminal prosecution on the violation if the violator pays to the city clerk, within fifteen (15) days of receipt of the complaint of such violation a civil assessment in the amount set forth in section 1-4-5 of this code.
Every day such violation continues after the date specified in the notice shall constitute a separate and distinct offense, punishable as provided in the general penalty in section 1-4-1 of this code.
