The person who engages in peddling or solicitation as defined in this chapter in violation of any provision of this chapter or fails in any way to comply with the requirements and procedures of this chapter shall be served with a notice of violation and shall thereafter be deemed guilty of a misdemeanor. However, the city's prosecuting attorney may elect to refrain from initiating criminal prosecution on the violation or failure to comply if the violator comes into compliance and pays to the city clerk a civil assessment in the amount set forth in section 1-4-5 of this code.
If there is not compliance and payment of the applicable penalties and assessments as set forth above, or upon any third offense, the offense shall be punishable as provided in the general penalty provisions set forth in section 1-4-1 of this code.
