3-2-9: OPEN CONTAINERS ON PUBLIC PROPERTY FOR SEATING AND DINING:
The City Clerk with the concurrence of the Police Department may authorize the possession of an "open container of an alcoholic beverage" (as defined in section 5-2-7 of this Code), and suspend the effect of section 5-2-7 of this Code, for up to one year at a time, upon specified portions of the public sidewalk upon documentation of the necessary liquor license, liquor liability policy, and a specific map showing what area of the sidewalk will be utilized. Specified portions shall be clearly delineated using a physical barrier such as, but not limited to, rope or temporary fencing and shall not impede pedestrian traffic. (Ord. 606, 8-5-2019)
