3-2-5: WINE REGULATIONS:
   A.   Definitions:
   RETAILER: Any person engaged in the sale or distribution of wine to the consumer.
   WINE: Shall be defined as provided in Idaho Code title 23, chapter 13, as amended from time to time.
   B.   License Required: It is unlawful for any person to sell wine without first obtaining a proper license.
   C.   Application For License:
      1.   Application for the retail sale of wine shall be made and filed with the city clerk in the same form and manner as a license to sell beer. At the time the application is filed, the applicant shall also present a copy of a license to sell wine obtained from the state. (Ord. 475, 3-7-2005)
      2.   All applications received and approved by the city clerk shall be forwarded to the chief of police for review and final approval. (Ord. 514, 9-15-2008)
      3.   Licenses will be for a period of no longer than one year and shall expire at one o'clock (1:00) A.M. on the first day of the renewal month for a state license as determined by the director of Idaho state police.
   D.   Qualifications: No retail license shall be issued to any applicant who is not qualified under Idaho Code title 23, chapter 13, as the same may be amended from time to time.
   E.   Fee For License: The fee for a license for the sale of wine shall be established by resolution of the city council.
   F.   Revocation Of License: The city council shall retain the right at all times to revoke and cancel any license, subject to the same rights to appeal as set forth in subsection 3-2-4F of this chapter relating to a license to sell beer.
   G.   Hours Of Sale Restricted: Wine sold for consumption on licensed premises may be sold only during the hours that beer can be sold pursuant to subsection 3-2-4G1 of this chapter.
   H.   Regulations: The sale of wine is subject to the same regulations as set forth in subsection 3-2-4H of this chapter relating to the sale of beer.
   I.   Renewal Of License: Renewal of a license shall be accomplished in the same manner as provided in subsection 3-2-4I of this chapter relating to renewal of a beer license. (Ord. 475, 3-7-2005)
