7-3-5: ENFORCEMENT AND ADMINISTRATION:
   A.   Enforcement:
      1.   Violations: It shall be unlawful for any person to:
         a.   Erect or install a street name sign not in accordance with this chapter.
         b.   Remove, alter, change, or deface a street name sign or address identification erected or installed as provided herein.
         c.   Place or post addresses not approved by this chapter.
      2.   Penalty: Any person who violates or fails to comply with any of the provisions of this chapter shall be subject to penalty and enforcement as follows:
The owner, or other person, who may be responsible for compliance with the provisions of this chapter, who has been notified of the violation or failure to comply, fails to comply and cure the violation within the time provided in the notice, shall be deemed guilty of a misdemeanor. However, the city's prosecuting attorney may elect to refrain from initiating criminal prosecution on the violation or failure to comply if the violator brings the property into compliance and pays to the city clerk within fifteen (15) days of receipt of the complaint of such violation a civil assessment in the amount set forth in section 1-4-5 of this code.
If there is not compliance and payment of the applicable penalties as set forth above, the offense shall be punishable as provided in the general penalty provisions set forth in section 1-4-1 of this code.
   B.   Administrative Procedures: The city council may, by resolution, adopt administrative procedures, create fee schedules, etc., to facilitate implementation of the purpose and intent of this chapter.
      1.   Amendments: The city council may amend, supplement or repeal the regulations and provisions of this chapter in the manner prescribed by Idaho Code. A proposed amendment, supplement or repeal may be originated by the city council, administrator or by petition. All proposals not originating with the administrator shall be referred to him/her for a report thereon before any action is taken on the proposal by the city council.
      2.   Controversial Or Disputed Street Names: The administrator shall have the discretion to refer any disputed street name, addressing issues or controversial street name changes to the city council for approval or resolution.
      3.   Appeals: Appeals concerning interpretation or administration of this chapter may be filed by any affected person. Such appeals shall be filed within a reasonable time of the action being appealed, not to exceed thirty (30) days, by filing with the administrator a notice of appeal specifying the grounds of the appeal. The administrator shall schedule a meeting with the council to hear the appeal and shall provide written notice to the affected persons of the time and place of the meeting. The affected persons and the administrator shall be provided an opportunity to present the relevant issues to the board at that meeting. The council's decision shall be final, and further recourse for the affected persons shall be to the courts as provided by law.
      4.   Appeal Not Granted For Special Privilege Or Exception: An administrative appeal shall not be granted if it would function as a grant of special privilege or to provide an exception to the regulations contained within this code.
