7-2-4: PROHIBITED PLANTINGS AND SPECIES:
   A.   Prohibitions:
      1.   No person shall plant any tree, hedge or shrubbery within any city right of way without first having received permission from the city council.
      2.   Under no circumstances shall a person plant any of the following species of tree, hedge or shrubbery within a city right of way:
         Ailanthus
         American elm
         Box elder
         Cottonwood
         Fruit trees (except ornamental types)
         Mountain ash
         Nut trees
         Oregon or big leaf maple
         Poplar
         Willow
   B.   Violations: Violations of any of the provisions of this chapter or failure to comply with any of its requirements shall constitute a misdemeanor and upon conviction, subject to penalty as provided in section 1-4-1 of this code. Each day such violation continues shall be considered a separate offense. (Ord. 482, 6-5-2006)
