7-1-2: ENCROACHMENTS:
   A.   Permit Requirements:
      1.   It is the responsibility of any person to first secure a right of way encroachment permit from the city before beginning any construction, maintenance or repair project within a city street, alley, sidewalk or right of way.
      2.   Fees for encroachment permits shall be established by resolution of the city council.
   B.   Utility Poles:
      1.   All utility poles hereafter set in the city shall be set within the line established by the city. Upon proper notification by the city that any street, alley or right of way is to be widened, vacated, paved or changed, any person having poles set in said street, alley or right of way of the city shall remove their poles therefrom and move them to the proper established line.
      2.   This subsection is intended to apply to all persons, companies or corporations now having franchises granted to them by the city, or who may hereafter obtain such franchise, or who may be operating or carrying on any business within the city requiring use of such poles.
      3.   The right to amend, alter or repeal this section is hereby reserved.
   C.   Right Of Way Obstructions: No person shall obstruct any city sidewalk, street, alley or right of way at any time for the sale or storage of any goods, wares or merchandise or for any event or gathering of people without first having obtained the permission of and having met the conditions set forth by the city council.
Violations of any of the provisions of this section or failure to comply with any of its requirements shall constitute a misdemeanor and upon conviction, subject to penalty as provided in section 1-4-1 of this code. Each day such violation continues shall be considered a separate offense. (Ord. 482, 6-5-2006)
