The provisions of this chapter shall not apply to the following individuals or materials:
A. Any sex therapist or similar individual licensed by the state to provide bona fide sexual therapy or counseling;
B. Licensed medical practitioner, licensed nurse, psychiatrist, psychologist, or other licensed healthcare professionals engaged in providing bona fide healthcare services;
C. Educators licensed by the state or teaching in an institution of higher education, who are engaged in teaching bona fide sex education classes; and
D. Educational materials sanctioned by the state or prescribed by licensed healthcare professionals. (Ord. 2006-002, 2006)
