§ 70.05 SKATEBOARDS AND SCOOTERS PROHIBITED IN COURTHOUSE SQUARE AREA AND TRAILHEAD AREA.
   (A)   Definitions. For the purpose of this section, the following terms shall have the meanings described herein:
      COURTHOUSE SQUARE AREA. The indicated blocks of the following streets: Fillmore Street from Houston Street east to Pleasant Street; Main Street from St. Paul Street east to St. Anthony Street; St. Paul Street from Main Street north to Fillmore Street; St. Anthony Street from Main Street north to Fillmore Street.
      SCOOTER. Any motorized of non-motorized device designed to propel a standing operator.
      SKATEBOARD. A wheeled self-propelled device designed to transport a rider, which device is not otherwise secured to a rider's feet or shoes.
      TRAILHEAD AREA. The city-owned land that is immediately adjacent to the Trailhead bathrooms and historic elevator. This area includes the sidewalks and ramps that service the Trailhead bathrooms and historic elevator.
   (B)   Skateboard and scooter riding prohibited. No person shall ride a skateboard or scooter on any public sidewalk or street, on any public parking lot, or in any public or private parking structure, situated in the Courthouse Square Area or Trailhead Area unless a permit has been obtained from the City Council.
   (C)   Permit. A person desiring to conduct an exhibition involving the use of skateboards or scooters in the Courthouse Square Area or Trailhead Area shall file an application with the City Administrator or designated representative at least three weeks prior to the date of the proposed exhibition. The application shall be in writing addressed to the City Council and shall contain the following information and such other information as the City Administrator or designated representative may request: the name of the person conducting the exhibition, the date(s) and approximate duration of the exhibition and the location of the exhibition.
   (D)   Exceptions. Nothing contained in this section shall be deemed to prohibit the use by a disabled person of a wheelchair or other wheeled device designed to assist the ambulatory disabled on the sidewalks or streets, public parking lots, or public or private parking structures, in the Courthouse Square Area or Trailhead Area.
   (E)   Enforcement. Any person committing a first offense violation of the provisions of this section shall be guilty of a petty misdemeanor punishable by a $25 fine. Any person committing a second offense violation of the provisions of this section shall be guilty of a petty misdemeanor punishable by a $50 fine. Any person committing a third or subsequent offense violation of the provisions of this section shall be guilty of a misdemeanor and, upon conviction for a violation hereof shall be subject to the terms of § 10.99.
