§ 33.10 RESERVATION OF RIGHTS BY CITY.
   The city reserves the right to do the following.
   (A)   Reject all or any part of a proposed development based on the determination that city facilities, sewer treatment, water pumping, storage and distribution and other city services, including the Fire Department, would not be adequate without major expansion, and funding is not available at the time of the presentation of the development, or for other reasons determined by the Council. In any event, the city shall not be obligated to the developer or any other person or entity to assist or provide any assistance, financial or otherwise, with respect to any proposed improvement, unless the city and developer shall have entered into a written agreement setting forth the respective obligations of the parties.
