§ 51.62 VIOLATIONS.
   (A)   Any person who violates any provision of this regulation shall be guilty of a misdemeanor and upon conviction shall be punished as provided by law. A separate offense shall be deemed to be committed each day that a violation occurs or continues.
   (B)   All premises affected by this subchapter shall be subject to inspection by the city, its personnel, health officer or other authorized agent. The city may collect samples for laboratory examination as deemed necessary for enforcement of this subchapter. No person shall refuse to permit the city to inspect any premises. No person shall molest or resist city personnel, Health Officer or other agents in the discharge of their duty in the protection of the public health.
   (C)   The existence of violations to this regulation are a threat and nuisance to the public, the groundwater and rivers or streams. Therefore, the city will notify the owner of the land where the violation exists that the violation must be corrected in accordance with this subchapter. The owner will be given 30 days to comply. In cases of imminent hazard, the compliance time may be shortened accordingly. If the owner does not comply within the compliance time limit, the city may cause the violation to be corrected. Any expenses incurred therefor shall be the responsibility of the owner, and if subsequently unpaid, shall be assessed against the property as provided by law.
