2-5-20: USE OF HOTEL TAX FUNDS:
All hotel tax revenues collected pursuant to the provisions of this chapter shall be set aside and used exclusively for the following purposes and no others:
   A.   The first two percent (2%) of all taxes levied and collected pursuant to this chapter shall be deposited into the general fund of the city of Poteau and shall be available to pay expenses incurred by the city of Poteau in the enforcement of this chapter. "Enforcement", as used in this chapter, shall include expenses incurred in monitoring the collection, expenditure and auditing of the hotel tax.
   B.   There is hereby established a special fund to be known as the hotel tax fund of the city of Poteau. Ninety eight percent (98%) of all taxes levied and collected pursuant to this chapter shall be deposited into the fund. This fund shall be used and expended by the city of Poteau, subject to budget review and approval by the city council; provided, however, that actual disbursements shall be made only by warrants drawn, approved and executed as required for other disbursements by the city, as follows:
      1.   To adopt plans, policies and programs to encourage family recreation, fitness, health and fun within and around the city of Poteau;
      2.   To construct, reconstruct, upkeep, operate, maintain and repair building and facilities including, but not limited to, sports fields, playgrounds, tennis courts, trails, fitness facilities, gymnasiums, skateparks, picnic shelters, picnic areas, swimming pools, splash pads and similar water activities, performing arts facilities, and other park and recreation facilities of whatever kind and nature;
      3.   The promotion of the city of Poteau as a place where recreation, fitness, health and fun is encouraged;
      4.   To foster and encourage recreation, fitness, health and fun events, activities, and locations within and around the city of Poteau to promote healthy living;
      5.   To adopt plans, policies and programs to encourage the economic development of the city as a convention and tourist center;
      6.   To construct, reconstruct, operate, maintain and repair buildings and facilities to encourage the economic development of the city of Poteau and to foster the development of the city as a convention and tourist center, and to acquire land in connection therewith; and
      7.   To promote events, civic functions, cultural events and activities in and around the Poteau economic region. (Ord. 722, 2-1-2012)
