2-5-13: ADMINISTRATION OF OATHS AND COMPELLING TESTIMONY:
   A.   The city clerk, or employees or agents of the city duly designated and authorized by him/her, or the city council, shall have the power to administer oaths and take affidavits in relation to any matter or proceeding in the exercise of the powers and duties under this chapter. The city clerk shall have the power to subpoena and require the attendance of witnesses and the production of books, papers and documents to secure information pertinent to the performance of his/her duties hereunder and of the enforcement of this chapter, and to examine them in relation thereto.
   B.   Any person who shall refuse to testify or to produce books or records, or who shall testify falsely in any material matter pending before the city clerk, or employees or agents of the city duly designated and authorized by him/her, or of the city council shall be guilty of an offense punishable by a fine of not more than two hundred fifty dollars ($250.00), excluding costs, and/or by imprisonment for a period of not more than thirty (30) days.
