11-10-6: OTHER PUD REQUIREMENTS:
The following requirements shall be met by any proposed PUD:
   A.   Open Spaces: The maintenance and perpetual existence of required private open spaces, easements and rights of way shall be guaranteed by creation of entries and the imposition of real conditions, covenants, and restrictions as required by the city council. A home association shall be created if a trust or other satisfactory arrangements have not been made for improving, operating, and maintaining common facilities including streets, drives, services, and parking areas, and recreation areas.
   B.   Lots Sold For Construction Purposes: When individual lots that are not a part of an approved and platted subdivision are to be sold for the purpose of construction, a new subdivision plat shall be submitted, approved, and filed with LeFlore County prior to the sale of lots and granting of any building permit.
   C.   Public Easements, Streets: In the event that a subdivision plat is not required for approval of the entire PUD, no building permit for any structure within the PUD shall be granted until conveyances for any required public easements, streets, rights of way, or other public areas shall have been accepted by the city council and filed with LeFlore County.
