9.44.030: NONCOMPLIANCE AND MULTIPLE FALSE ALARMS; SERVICE FEES, REMEDIES, AND PENALTIES:
   A.   Failure to comply with the requirements or prohibitions of section 9.44.020 of this chapter shall be subject to the imposition of a service fee upon the occupant of the affected premises, or the owner, if the premises is not occupied, in accordance with a fee schedule established by resolution of the city council. Such fee schedule shall reflect the relative level of costs incurred by the city as a result of the building occupant's/owner's noncompliance. Said fee shall be billed by the city's finance department, and if not paid within thirty (30) days of the occurrence, may be appended to the municipal utility bill of the premises involved, subject to all collection remedies and terms provided therefor. Such service fee charges may also be separately collected in a manner deemed appropriate by the finance director.
   B.   Multiple false alarms, in excess of two (2) from the same location or alarm system within a six (6) month period, continuously and cumulatively until a six (6) month period free of false alarms has been achieved, shall obligate the occupant/owner to pay a service fee as set forth in a resolution adopted by the city council which shall become due and payable no later than thirty (30) days after occurrence of the third false alarm in a six (6) month, or longer, period. Said fee shall be billed by the city's finance department, and if not paid within thirty (30) days, be appended to the municipal utility bill of the premises involved, subject to all collection remedies and terms provided therefor.
   C.   The occurrence of more than three (3) instances of the conduct prohibited or omission of that required by section 9.44.020 of this chapter within any continuous six (6) month period shall constitute a violation of this chapter. The occurrence of more than five (5) accidental or unintentional false alarms within the six (6) month period (or longer until 6 continuous months are free of false alarms), as described in subsection B of this section, shall constitute a violation of this chapter. A violation of this chapter shall constitute a misdemeanor, punishable as provided in title 1, chapter 1.24 of this code. (Ord. 1152 § 11, 2008)
