509.08 SUPPRESSION OF RIOT.
   (a)   The City Manager, when engaged in suppressing a riot or when there is a clear an present danger of a riot, may cordon off any area threatened by such riot and prohibit persons from entering such area except when carrying on necessary and legitimate pursuits, and may prohibit the sale, offering for sale, dispensing or transportation of firearms or other dangerous weapons, ammunition, dynamite or other dangerous explosives in, to or from any such area. No person shall purposely or knowingly fail to obey a lawful order of any sheriff, police officer or other officer given pursuant to this section. (Ord. 1968-58. Passed 6-27-68.)
   (b)   When there is a tumult, riot or mob or body of people acting together with the intent to commit a felony or to do or offer violence to any person or property, or by force and violence to break or resist the law, or in the event of a flood, fire, snowstorm or any other disaster affecting life and property and that substantially impairs the functioning of the City government and its ability to protect the lives and property of the people, any of the following named officers, acting in the order herein designated when the previously names officer or officers are absent from the City or are unavailable or incapable of doing so, are authorized to proclaim the existence of a state of emergency in the City or within any prescribed area thereof: the City Manager, the President of Council, the Vice-President of Council and the Chief of Police.
   (c)   When a state of emergency has been proclaimed as provided in subsection (d) hereof, any of the officers named therein, acting in accordance therewith, is authorized to issue any proclamation he deems necessary to protect life and property. Such proclamation may include, but is not limited to, the establishment of a curfew, prohibiting the sale of beer or intoxicating liquor, prohibiting the sale of firearms, restricting or prohibiting movement into, out of, or within, the affected area or areas, or prohibiting or limiting the assemblage of persons.
   (d)   No person shall fail to obey a lawful order of any police officer, militiaman or other law enforcement officer given pursuant to this section. No person shall in any way knowingly interfere with any such police officer, militiaman or other law enforcement officer, or a fireman, rescue personnel, medical personnel or any other authorized person in the protection or preservation of life or property during the existence of a state of emergency proclaimed as provided in this section.
