339.02 TRUCKS AND TRUCK ROUTES.
   (a)   Definitions. As used in this section:
      (1)   "Inter-City" truck means a self-propelled vehicle used for the transportation of goods and having a manufacturer's rating of one ton capacity or more (except those carrying passengers for hire), operating:
         A.   From a point outside the City limits through the City to a point outside the City limits;
         B.   From a point outside the City limits to a point within the City limits; or
         C.   From a point within the City limits to a point outside the City limits.
      (2)   "Intra-City" truck means a self-propelled vehicle used for the transportation of goods and having a manufacturer's rating of one ton capacity or more (except those carrying passengers for hire), operating from a point within the City limits to another point within the City limits.
      (3)   "Self-propelled vehicle" means a trailer or semitrailer propelled by a truck or tractor.
   (b)   Routes to be Followed.
      (1)   Inter-City trucks, as defined in subsection (a)(1)A. hereof, shall enter the City, pass through the City and leave the City upon established truck routes only, and shall not drive upon any other public street of the City at any time except upon the direction of a City or State police officer or to follow a marked and established detour or to obtain necessary emergency mechanical repairs.
      (2)   Inter-City trucks, as defined in subsection (a)(1)B. hereof, shall enter the City and proceed to the point within the City which is their destination by following the established truck routes to the street intersection on such route nearest their point of destination and then following such other street or streets by the shortest practical route to their destination.
         Such trucks shall not be driven upon any other public streets of the City at any time except upon the direction of a City or State police officer or to follow a marked and established detour or to obtain necessary emergency mechanical repairs.
      (3)   Inter-City trucks, as defined in subsection (a)(1)C. hereof, shall proceed from the point within the City which is their starting point, by such street or streets as constitute the shortest distance from their starting point to a truck route, and shall then follow such truck route to the City limits and shall not drive upon any other public street of the City at any time except upon the direction of a City or State police officer or to follow a marked and established detour or to obtain necessary emergency mechanical repairs.
      (4)   Intra-City trucks, as defined in subsection (a)(2) hereof, shall proceed from the point of beginning by the shortest distance to a truck route, and shall follow such truck route to the street intersection nearest the point of destination and shall then follow such other street or streets by the shortest practical route to their destination.
         If such a truck is to make several pickups or deliveries during the same trip, such truck may continue from place to place, using truck routes when practical, until the last pickup or delivery is made, then return by the shortest practical route to the truck route, to return to its point of beginning.

      (5)   Intra-City trucks hauling such materials as dirt, gravel, slag, ready-mixed concrete, asphaltic concrete or other like material, from a central supply source or to a point where such materials are used, which points are not on or near a truck route, which hauling requires frequent trips over a period of hours or days, are required to follow such street or streets as are designated by the City Manager, and the City Manager, with the advice of the City Engineer and the Chief of the Police Department, is hereby authorized to designate the route or routes to be traveled by such trucks, based upon the condition and width of the streets, the traffic condition thereon, the type of truck to be used and any and all other conditions then and there existing.

   (c)   Truck Routes Designated. For the purpose of this section, the following streets and routes are hereby established as truck routes within the City:
      (1)   Traffic entering the City from the western terminus of the City on Eleventh Street shall proceed eastbound on Eleventh Street to Gallia Street and U.S. 52 to the eastern terminus of the City. Northbound traffic shall proceed north on Gay Street to Chillicothe Street; thence north on Chillicothe Street and Scioto Trail to the northern terminus of the City.
      (2)   Traffic entering the City from the eastern terminus of the City shall pass west on U.S. 52 and Gallia Street to Robinson Avenue and Twelfth Street, to Gay Street. Northbound traffic shall then follow Gay Street north to Chillicothe Street, and thence north on Chillicothe Street and Scioto Trail to the northern terminus of the City. Westbound and southbound traffic shall continue west on Twelfth Street to the western terminus of the City.
      (3)   Traffic entering the City from the northern terminus of the City shall proceed south on Scioto Trail to Chillicothe Street and continue south on Chillicothe Street to Twelfth Street, from which point, westbound and southbound traffic shall proceed west on Twelfth Street to the western terminus of the City. Eastbound traffic shall proceed south on Chillicothe Street to Eleventh Street to Gallia Street, and follow Gallia Street and U.S. Route 52 to the eastern terminus of the City.

      (4)   Traffic departing from Harmon Street shall proceed northbound on Harmon Street to Young Street and proceed northbound to U.S. 52 East or West. (Ord. 2011-42. Passed 9-26-11.)
      (5)   This section shall ban all through truck traffic, as defined in subsection (c)(6), from streets not posted as through truck routes. U.S. 23 north and south traffic will be rerouted to use the Carl Perkins Bridge west of the City rather than the U.S. Grant Bridge. Trucks making local pick-up or deliveries to the downtown business district are exempted.
      (6)   Heavy vehicle shall mean any self-propelled or towed vehicle used on public highways in commerce to transport passengers or property and:
         A.   Has either a gross vehicle weight rating or actual gross weight or gross combination weight rating or actual gross combination weight of 10,001 or more pounds.
         B.   Is designed or used to transport more than eight passengers, including the driver; for compensation.
         C.   Is designed for carrying 16 or more passengers, including the driver; and not for compensation.
         D.   The vehicle is used in the transportation of hazardous materials in a quantity that requires the vehicle to be placarded pursuant to 49 CFR, parts 100 to 180.

   (d)   EDITOR’S NOTE: Former subsection (d) hereof was repealed by Ordinance 2016-66.
   (e)   Violations. No person shall operate a truck in the City in violation of any of the provisions of this section. (Ord. 1969-69. Passed 6-26-69.)
   (f)   Penalty. Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
