775.01 APPLICABILITY.

   (a)    "e-Scooter" shall mean a motorized scooter consisting of a footboard mounted on two (2) wheels, with a long steering handle, propelled by electric motor or another type of motor such that the rider of an e-scooter is able to keep both feet on the vehicle's footboard while riding. An "e-scooter" is different from a non-motorized "scooter".

   (b)    This chapter applies to any person engaged in the business of providing e-scooter rental or sharing services to the public within the City.

   (c)    The requirements of this chapter shall supplement the provisions of Part Three, Traffic Code, "Traffic Code," of the Portsmouth Codified Ordinances.

   (d)    No person shall engage in the business of e-scooter rental or sharing services to the public within the City unless that person has obtained a permit from the City to engage in such a business. The provisions of this Chapter are:

   (e)    No person shall obtain a permit from the City until that person has complied with the following:

      (1)    Submitted a timely and complete application for a permit or timely and complete response to a request for proposals conducted by the City;

      (2)    Paid the application fee established by the City Manager, if applicable;

      (3)    Posted a bond and obtained the insurance required by Section 775.04; and

      (4)    Executed a permit agreement with the City for the provision of e-scooter rental or sharing services.
