(a) Adoption of Standard Codes. Pursuant to the provisions of Ohio R. C. 731.231, the Ohio Fire Code, promulgated by the Department of Commerce, State of Ohio, Division of State Fire Marshal, is hereby adopted by the City and incorporated by reference as if fully set out herein, save and except such portions as may be hereinafter amended, modified or deleted.
The purpose of the Ohio Fire Code, as adopted herein, is to prescribe regulations consistent with the general laws of the State and nationally recognized good practice for the safeguarding, to a reasonable degree, of life and property from the hazards of fire and explosion arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the use or occupancy of buildings or premises.

(b) Intent of Code. It is the intent of the Fire Prevention Code to prescribe regulations consistent with both State and nationally recognized good standards and practices for the safeguarding of life and property from the hazards of fire and explosion. Compliance with the latest standards of the American Insurance Association, the National Fire Protection Association, the National Fire Codes, the Ohio State Fire Code or other approved state or nationally recognized safety standards shall be deemed to be prima-facie evidence of compliance with this intent.
(c) Application of the Code. The provisions of the City Fire Code shall apply equally to new and existing conditions:
(1) All newly constructed buildings shall comply with the intent of this Code prior to their being occupied.
(2) All existing buildings shall comply with the intent of this Code within one year of the effective date of this section.
(3) All buildings that are vacated or closed for thirty days shall comply with the intent of this Code prior to their being reoccupied.
(4) If, in the event of a building or a business changing ownership or occupancy, then this building or business shall be required to comply with the intent of this Code immediately.
(d) Authority to Enter Premises. The Chief of the Fire Department, Chief of the Fire Prevention Bureau or any inspector that they may assign, may at all reasonable hours enter any building or premises for the purpose of making any inspection or investigation which, under the provisions of the Fire Prevention Code, he, she or they may deem necessary.
