905.06 SIDEWALK REPAIR; RESPONSIBILITY OF ABUTTING OWNERS; REMEDY BY CITY.
   It shall be the duty of the owners of lots abutting on sidewalks in the City to keep such sidewalks in good repair in front of their premises and to prevent any unevenness in the surface grade of such sidewalks by any reason whatsoever. However, should it be determined by the City Forester that the damage or unevenness is caused by the City planting trees within the immediate area; the City shall then make the repair at no expense to the abutting property owner.
   It shall be the duty of the Auditor, upon resolution by Council, to first cause notice to be given to the owner of premises abutting upon such sidewalk of any necessary repairs or improvements. If such owner shall not within thirty days thereafter make the necessary repairs or improvements in such sidewalks, the same shall be done by the City or its designated agent. The expense of such necessary repairs or improvements shall be assessed upon the premises so abutting and shall be certified by the proper City official to the County Auditor, and such assessment shall act as a lien upon the property of such owner and shall be collected as provided for in the case of special assessments.
