Any person engaging in the business or trade of itinerant vendor shall pay a license fee of one hundred dollars ($100.00) per annum. No such license shall be granted until the applicant therefor has furnished a bond signed by a surety company authorized to do business in the State, approved as to sufficiency by the City Manager and as to form by the City Solicitor, conditioned to reimburse any person for any and all damages resulting from any act on the part of the licensee or his agent or employee or from the failure of the licensee to carry out any contract entered into by him or in his behalf with any person or any obligation entered into by the licensee by or in behalf of the licensee while conducting the business of itinerant vendor under the license issued under the authority of this section. Such bonds shall be in the amount of one thousand dollars ($1,000).
Every person preparing to engage in any business set out in this chapter shall, unless the City Manager is satisfied that the business about to be engaged in is of a permanent nature and not that of an itinerant vendor, be required to secure a license as an itinerant vendor and give bond as provided for in the first paragraph of this section. If, after nine months from the date of the issuing of the license, the holder thereof is still engaged in his business as originally opened, the City Auditor is hereby authorized, upon a proper warrant signed by the City Manager, to refund the fee paid to obtain the license to such licensee and release the licensee from the obligation of giving bond.
The words "itinerant vendor", as used in this section, mean and include all persons, both principals and agents, who engage in or conduct a temporary or transient business in the City selling goods, wares or merchandise, or who engage in the business of taking photographs, with the intention of continuing in such business in the City for a period of not more than nine months and who, for the purpose of carrying on such business, hire, lease or occupy, either in whole or in part, any room, building or structure for the exhibition and sale of such goods, wares and merchandise.
