545.21 FLOOD DEFENSE; INTERFERENCE OR TAMPERING WITH LEVEES AND EMBANKMENTS.
   (a)   No person, other than an employee of the City in the course of his employment or upon the lawful order of an officer of the City, shall interfere or tamper with any levee or embankment in the City or remove or disturb any part or portion thereof or remove therefrom any materials or appliance of whatever nature or kind or open or close any valve or water connection between the City and the Ohio River or the Scioto River.
   All flood defenses of whatever nature, including earthen or rock fills or embankments, concrete walls or levees, together with all valves, pumps, gates and all appurtenances thereto, including willows or other growing things planted for the purpose of strengthening banks, embankments or levees, which have been or which may hereafter be constructed or placed by the City, shall be designated as levees and embankments.
   (b)   Whoever violates this section is guilty of a misdemeanor of the third degree.
