§ 160.241 EXEMPTIONS.
   This subchapter is not, and shall not, be held to be applicable to:
   (A)   Structures erected by units of government; and
   (B)   Mobile elevated structures attached to moveable equipment, provided such mobile elevated structures are not in use for a period of greater than 90 days in a calendar year, and are not placed within 100 feet of a residence, park or school.
