§ 120.04 ISSUANCE OF PERMIT.
   (A)   The City Secretary shall approve issuance of a permit to an applicant within 30 days after receipt of an application unless the Chief of Police finds any one of the following to be true:
      (1)   An applicant or an employee is under 18 years of age;
      (2)   An applicant or an applicant's spouse is overdue in payment to the city or county of taxes, fees, fines, or penalties assessed against or imposed upon real and/or personal property;
      (3)   An applicant, an applicant's spouse or an employee has been convicted of a violation of a provision of this chapter or any other ordinance within a period of two years preceding the application;
      (4)   Any fee required by this chapter has not been paid;
      (5)   An applicant, an applicant's spouse or an employee, if the operator is a business entity, has been convicted of a felony or a crime of moral turpitude as defined in the Tex. Penal Code within a period of ten years preceding the application;
      (6)   An applicant, an applicant's spouse or an employee has been convicted of any gambling offense described in Tex. Penal Code Chapter 47 within a period of ten years preceding the application; or
      (7)   An applicant, an applicant's spouse or an employee has been convicted of public lewdness, indecent exposure, or indecency with a child as defined in Tex. Penal Code Chapter 21 within a period of ten years preceding the application.
   (B)   The fact that a conviction is being appealed has no effect on the disqualification of the applicant, the applicant's spouse or an employee under this chapter. Any conviction, even under appeal, disqualifies any applicant.
   (C)   The City Secretary, upon approving issuance of an amusement redemption machine or device establishment or amusement redemption machine or device premises permit shall send the applicant, by certified mail, return receipt requested, written notice of that action and state where the applicant must pay the permit fee and obtain the permit. The City Secretary's approval of the issuance of a permit does not authorize the applicant to operate an amusement redemption machine or device establishment or amusement redemption machine or device premises until the applicant has paid all fees required by this chapter, obtained possession of the permit and passed initial inspection by the City Building Inspector or his agent.
