(A) Generally.
(1) Any person, firm, corporation or agent who shall violate any provision of this chapter or fail to comply therewith or with any of the requirements thereof, shall be guilty of a misdemeanor.
(2) Each person, firm, corporation or agent shall be guilty of a separate offense for each and every day, or portion thereof, during which any violation of any of the provisions of this chapter are committed or continued; and upon conviction of any violation, the person, firm, corporation, or agent shall be punished by a fine in an amount not to exceed $1,000.
(B) Political signs.
(1) Any person who intentionally violates the provisions of § 157.042(A) and (B) of this chapter shall be guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed $250. Each violation occurring within a 24-hour period shall be considered a separate violation. A summons shall be issued in the event of a violation and criminal enforcement action under § 157.042(A) and (B).
(2) Any person who intentionally violates the provisions of § 157.042(E) of this chapter shall be guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed $1,000. In addition to the criminal penalty provided for herein, any political sign in violation of § 157.042(E)(1), (E)(2) and (E)(3) may be summarily removed and discarded by city employees at the direction of the Enforcement Officer and the city shall also retain the remedies provided to the city pursuant to this chapter. A summons may be issued in the event of a violation of and criminal enforcement action under § 157.042(E).
(C) Civil enforcement. In addition to the criminal penalties and other remedial provisions contained in this chapter and other regulations of the City of Port Isabel, the City Attorney or his designee may enforce the provisions of this chapter through any and all civil remedies available. In such event, persons against whom enforcement is sought and against whom civil remedies are granted shall be jointly and severally liable for all damages, court costs, attorney's fees, and all other costs and expenses incurred by the city and reasonably related to the civil enforcement action.
