(A) These rules and regulations are the standard requirements of signs within the city. A suspension of any of these rules and regulations may be granted by the Board of Adjustments and Appeals upon a showing that there are special circumstances or conditions affecting the sign in question, that enforcement of the provisions of this chapter will deprive the applicant of a substantial property right, and that the suspension, if granted, will not be materially detrimental to the public welfare or injurious to other property or property rights in the vicinity.
(B) In cases where a variance request to the Board of Adjustments and Appeals would not be appropriate, an applicant may elect instead to request a special permit from the City Commission pursuant to the process set forth in § 160.186. In order to qualify for a special permit, the applicant must show that the proposed signage will provide an aesthetically desirable and appropriate artistic, cultural, social, or historical contribution to the visual appearance of Port Isabel. Upon such a showing, the Port Isabel City Commission may allow the special permit with such changes, restrictions, or reservations it deems appropriate.
